The Renewable Energy Directive 2018/2001 (RED II) in Article 24 (4) sets the legal basis for allowing third parties which produce heat from renewable sources to be connected to the network of district heating operators. RED II was adapted and adopted in the Energy Community legal framework at the Ministerial Council in November 2021, imposing an obligation on the Contracting Parties to transpose it by 31 December 2021. In its Discussion Paper on Tariff Setting in District Heating, the Energy Community Secretariat concluded that the national legislation of all Contracting Parties contains provisions on allowing third parties to feed heat into the network. However, further work is needed for the implementation of Article 24 of RED II.
